1022 University Avenue SE is a multi-building site that contains six residential structures, including one large apartment building, Florence Court. Florence Court is a local historic landmark that was designated in 1983. Florence Court is renowned example of early urban planning in Minneapolis. The row houses, located around an interior courtyard, are the earliest surviving example of its type in Minneapolis.

The Florence Court parcel is unique in that a historically designated structure is located on the same tax parcel as other structures that do not have the same protection. When Florence Court was locally designated in 1983, the nomination from staff recommended that all the structures on the site be designated. At that time, the City Planning Commission (CPC) reviewed local historic designations and the CPC’s recommendation for Florence Court was that only the L-shaped apartment building, known as Florence Court, be designated. That recommendation was adopted by the City Council (per 599.2601).

-FLORENCE COURT TIMELINE NEEDS CITY INVOLVEMENT: The board generally favored the latest iteration of developer Clark Gassen’s housing plan for the Florence Court site at 1022 University Ave. SE. However, many board members voiced serious apprehension about Gassen’s timeline for rehabilitating the historic, L-shaped row houses, the four frame houses, and the courtyard.

At the meeting on Sept. 16, board members had resolved to ask the developer to sign an agreement stating that restoration of the historic elements of Florence Court would be 100 percent completed before the new construction was 75 percent finished. Gassen told the Land Use Committee that he would need the rental revenue from the new apartments to fund the rehabilitation. Gassen countered with an agreement that would allow him until the summer of 2010 to begin restoration. Board members were reluctant to sign an agreement that, as board Vice President Bob Distad pointed out, "we have no way of enforcing."

Ward 3 Council Member Diane Hofstede agreed to set up a meeting between the city attorney’s office and MHNA to help craft an enforceable agreement. The implication of the city’s involvement is that it would act as an enforcement agency should the developer try to renege on his agreement.

The board resolved to obtain a document from the City Attorney’s Office that details the enforceability of the developer’s commitment to rehabilitate Florence Court and the mechanism by which MHNA can hold the developer to his timeline. "3E[MSP website"]
